CJP Afridi snubs IHC transfer move saying ‘judges not disposable’

ISLAMABAD: Chief Justice of Pakistan (CJP) Yahya Afridi on Thursday formally declined a request by the Chief Justice of the Islamabad High Court (IHC) to convene a meeting of the Judicial Commission of Pakistan (JCP) for the transfer of five IHC judges, warns that such a move would set a “potentially far-reaching precedent” and undermine judicial independence.

Anchorperson Fahad Husain revealed that the decision comes amidst intense speculation surrounding the 27th Constitutional Amendment, with reports suggesting the government intends to facilitate the transfer of superior court judges between various high courts.

In a strongly-worded written order, CJP Afridi emphasized that treating judges as “administratively interchangeable or disposable” carries serious implications for the institutional integrity of the judiciary.

“It must also be borne in mind that permitting such transfers would set an undesirable and potentially far-reaching precedent,” the Chief Justice wrote, adding that such an approach would erode public confidence in the stability of the legal system.

The CJP’s remarks appear to be a direct rebuttal to recent legislative maneuvers aimed at altering the security of tenure for the superior judiciary. He noted that the proposed transfers, if sanctioned, would effectively take on a “punitive character” against the judges involved—a concept he described as “wholly alien” to the constitutional scheme.

“Such an outcome finds no sanction anywhere in the constitutional scheme governing the superior judiciary… and runs contrary to the foundational principles of judicial independence and security of tenure,” the order stated.

Legal experts view this development as a significant assertion of judicial autonomy. By invoking the spirit of Article 200 of the Constitution, CJP Afridi has signaled that the transfer of judges cannot be used as a tool for administrative convenience or political expediency.

While the Chief Justice has declined the requisition in his capacity as Chairman of the Commission, the door is not entirely closed. Under the rules of the JCP, the Secretary can still call a meeting if a majority of the members approve the request.

The backdrop of this standoff includes reports from Wednesday suggesting that the government is seeking to transfer five IHC judges to other provincial high courts. Critics of the move have characterized it as an attempt to “pack” or “thin out” benches that have recently issued rulings unfavorable to the executive.

As the debate over the 27th Amendment intensifies, the CJP’s refusal to accede to the IHC Chief Justice’s request sets the stage for a potential constitutional showdown between the head of the judiciary and those advocating for greater executive oversight of judge placements.

For now, the five judges remain at the Islamabad High Court, their fate tied to a broader struggle over the “foundational principles” of the Pakistani legal system.
