KARACHI: Sindh High Court on Monday declared null and void the notification of Sindh government under which accused, acquitted in Perween Rahman murder case, were kept in detention.

One of the accused, Mohammad Imran Swati, had submitted in the petition that he was acquitted in the murder case by the Sindh High Court as the prosecution had failed to prove charges against him and other co-defendants.
He submitted that after he was acquitted, the Sindh home department had on December 1 issued a notification to detain him and 4 other co-accused for 90 days under the MPO despite his acquittal.

A counsel for the petitioner submitted that the high court had acquitted the petitioner even of terrorism charges and there was no reason mentioned for their detention under the MPO. The high court was requested to set aside the impugned detention order.
During the course of proceedings today, the SHC asked provincial police chief and secretary home department to explain as to why the petitioners had been kept under detention?
Justice K K Agha expressed extreme displeasure when police and government officials failed to explain and justify detention of petitioners, on which the bench even warned them to take action and send them behind bars.

At one point, the court even sought Advocate General’s opinion about taking action against police officials for ‘poor investigation’.
When the court went into session after a short break, the bench voided Sindh government’s notification under which petitioner Imran Swati and 4 others were kept under detention for 90 days.
