Pakistan has been a victim of political tussle and wrangle among the different pillars of the state since a long time, in which the statements of the Prime Minister, Chief Justice and Federal Ministers and various actions against each other have been important.
It is the duty of the Supreme Court of Pakistan to ensure the implementation of the Constitution of Pakistan to end the ongoing political conflict in the country, only in this case the political dilemmas can be ended, but the result of prolonging the court proceedings has come before us.
Recently Federal Interior Minister Rana Sanaullah said that the government will file a reference against the Chief Justice of Pakistan and other 2 judges of the Supreme Court. He also made allegations that the Chief Justice and other 2 judges themselves are not listening to other judges and the government.
The federal government is clearly against holding the election on time. In such a case, the reference against the judges during the hearing of the election delay case raises serious questions about the intention of the government. It seems that the government wants to put pressure on the judges.
If the government wants to file a reference against the Chief Justice, the reason should be legal and constitutional, not because the decision was not in our favor, so, the Chief Justice will be boycotted. This attitude of the government will undermine the independence of the judiciary.
Undoubtedly, the attitude of both the caretaker government of Punjab and the federal government regarding the postponement of the elections in Khyber Pakhtunkhwa and Punjab remained alarming. Chairman PTI Imran Khan demanded to hold elections in 90 days according to the law, but the Election Commission, deviating from the constitution, has postponed the elections till October.
It is necessary that the Supreme Court should also take a strong stance against undermining the independence of the judiciary by the federal government so that no political official can get a chance to raise a finger on the judiciary in the future. Because the judiciary must not be influenced by the government or any political party for the true performance of its duties.
In this regard, the government also has to respect the rule of law and follow the decisions of the Supreme Court. It is through such measures that both the judiciary and the legislature will be strengthened in Pakistan and Pakistan will be able to become an Islamic welfare state in the true sense.
