A shock to hopes of justice?

Sheeraz Sattar by Sheeraz Sattar

Reading Time: 2 mins read

The surprising verdict of the Supreme Court on the night between 26 and 27 July reminded another similar decision of the top court under the headship of Chief Justice Umar Atta Bandial, according to which first the National Assembly was restored and then the former prime minister Imran Khan lost his government as a result of no-trust motion.

The Supreme Court’s recent decision divested Hamza Shehbaz of the Chief Ministership and awarded the same post to Chaudhry Pervaiz Elahi, which has annoyed the Muslim League (N) and allied political parties, especially the Jamiat Ulema-e-Islam (F), while  Prime Minister Shahbaz Sharif gave a clear message about the recent decision of the court.

In his message on Twitter, Prime Minister said that forming a full court on the issue was a need of the credibility of the country’s top court. The court decision has let down law experts, lawyers, media, and people who were expecting justice. It should be noted that Prime Minister Shehbaz Sharif did not issue such a statement when Imran Khan had lost his government after a similar decision of the court.

After the court verdict, the PM also said: “The constitution has assigned authorities to the parliament, administration, and judiciary, and all these institutions are bound to work within their constitutional limits. No institution can interfere with the authority of another. We will not compromise on the supremacy of the Constitution and Parliament.”

As if according to the statement of the Prime Minister, the decision of the Supreme Court was against the supremacy of the Parliament and Constitution. Here, our small and innocent question is that Deputy Speaker Qasim Suri had given a ruling against the removal of Imran Khan but the Supreme Court declared it null and void, wasn’t it against the constitution?

If the decision of the Supreme Court was in favor of Hamza Shehbaz, all the parties of the ruling coalition including PML-N would have accepted it wholeheartedly, but since the highest court of the country decided against the government and the son of the Prime Minister, Hamza Shahbaz had to lose power, so neither PML-N nor Jamiat Ulema-e-Islam (F) will accept this decision. Don’t the people have the right to ask why this is so?

Earlier, Deputy Speaker Qasim Khan Suri while presiding over the National Assembly session ruled that the no-confidence motion brought by the opposition is the result of an external conspiracy, so I reject it. The Supreme Court ruled that the Deputy Speaker’s ruling is wrong. Dost Muhammad Mazari decided to keep Hamza Shahbaz as Chief Minister by giving his ruling. The Supreme Court then ruled that the ruling was wrong.

To be considered, the Supreme Court has tried to end the dictatorship of the post of Deputy Speaker by using its powers as the pillar of the state, and that too only because the politicians had approached the top court of the country themselves for solving the political issues. If you stop taking your problems to the Supreme Court, such decisions will not be given.
